These General Terms and Conditions apply to your use of this online shop and to the sale of goods to you by Harpar Grace International Limited. Please read them carefully before placing an order.
1. Scope
These General Terms and Conditions apply to all orders placed through this online shop with Harpar Grace International Limited, and to our future business relations with you. We do not accept any conflicting or additional terms put forward by you unless we have expressly agreed to them in writing.
2. Contractual partner, formation of contract and correcting your order
Your contract is with Harpar Grace International Limited. The display of products in our online shop is an invitation to treat and not a binding offer. By placing items in your basket and completing the checkout, you make a binding offer to buy the goods in your basket. Before submitting your order you can review your selections and correct any input errors using the functions provided in the checkout. A contract is formed when we accept your order by sending you a dispatch confirmation. We acknowledge receipt of your order by email as soon as you place it; this acknowledgement does not by itself amount to acceptance of your order.
3. Contract language and storing the contract text
The contract language is English. We store the details of your order and send a confirmation to you by email. Where you have created an account, you can also view your orders by logging in.
4. Delivery
We deliver the goods you order; collection in person is not available. Any delivery costs are added to the price of the goods and are shown to you before you place your order. Further information is set out in our Delivery Policy.
5. Payment
Payment is taken securely at the checkout using the methods shown there, which may include major debit and credit cards and PayPal. All prices are shown in pounds sterling (GBP) and include VAT where applicable. Any delivery costs are shown separately before you place your order. Card payments are processed by our payment providers at the time your order is placed.
6. Your right to cancel
If you are a consumer, you have the right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You may cancel within 14 days of receiving your goods, without giving a reason. Details of how to return items and how refunds are issued are set out in our Returns Policy. This does not affect your statutory rights. Business customers are not granted a voluntary right to cancel.
7. Retention of title
The goods remain our property until we have received payment in full. For business customers, we retain ownership until all claims arising from the business relationship have been settled.
8. Damage during delivery
If your goods arrive with visible damage, please report this to the carrier where you can and contact us promptly so that we can help. Reporting damage in this way does not affect your statutory rights as a consumer.
9. Faulty goods, warranties and guarantees
Under the Consumer Rights Act 2015, the goods we supply must be as described, fit for purpose and of satisfactory quality. If goods are faulty or not as described, you are entitled to a repair, replacement or refund in line with your statutory rights. Where we need to examine returned goods, we will cover the cost of return for items found to be faulty. We aim to respond to complaints within 14 days. Any additional guarantee offered with a product is described on the relevant product page and applies in addition to your statutory rights.
10. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law. Subject to this, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or of our failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable.
11. Resolving disputes
If you are unhappy with any aspect of your order or our service, please contact us using the details below and we will do our best to put things right. As a consumer, you have statutory rights that are not affected by these terms, and you may seek free independent advice, for example from Citizens Advice.
12. Governing law and final provisions
These terms, and any contract formed under them, are governed by the law of England and Wales. If you are a consumer, you may bring proceedings in the courts of the part of the United Kingdom in which you live. If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in full force and effect.
